Helping you Understand New Jersey Alimony

When considering alimony a court will analyze many different factors to determine what is fair. Unlike child support, New Jersey alimony is not determined by a complex set of formulas. The court examines a variety of factors to determine what amount, if any is appropriate.

N.J.S.A. 2A:34-23 sets forth multiple factors that a court is required to consider in making an alimony award.   • Rehabilitative alimony: This is support given to an ex-spouse to become self-supportive through education and job training. This support is of limited duration agreed upon by the parties based upon the rehabilitative event being achieved. It is helpful to have an experienced lawyer to determine an appropriate award.
  • Permanent alimony: This is support determined by the courts that lasts an indefinite period. This determination is based on multiple factors. You need an experienced attorney to aggressively pursue what is fair and appropriate for you.
  • Limited duration (term) alimony: This is an alimony award that is for a fixed period of time, though typically until either the payor or the payee dies. Under certain circumstances, the alimony may be modified or terminated based upon a cohabitation by the obligee. Usually it is an amount to supplement income during the divorce.
